+ A hotel lessee refused to both pay rent and move out.
PROBLEM:
Lessee stopped making monthly lease payments to the Client while continuing to operate the business
Lessee also lived on-site at the hotel and refused to leave
Client wanted Lessee out as Tenant; wanted them to leave the premises so that Client could take over the operation and generate income
SOLUTION:
Landlord was able to regain control of operations to generate income and lessee could stay on-site for a short transitional period
Completed a new lease with new Tenant

Tenant could not pay rent due to COVID-19 government regulations - the shelter-in-place mandate effectively shut down Tenant’s business

Partner first with Client to identify how aggressive he wanted to be with Tenant, so we knew how to approach the negotiations
This led to the business decision, which guided the legal solution and document – the lease modification
Drafted a legal lease modification with crisp and precise language so there was zero confusion

“In the middle of COVID-19, we were renegotiating a contract for one of our properties. The Tenant—a healthcare provider—unsurprisingly was asking for certain concessions due to the effects of COVID-19 and the subsequent lockdown on the business. It was a very difficult situation for us to navigate legally and emotionally due to the pandemic. This was new territory for us. We felt significant anxiety trying to come up with a solution that we deemed fair for all sides, while maintaining empathy for the situation the business was in.
